Federal Judge Dismisses Just Born Lawsuit against BCTGM Local 6

A Federal judge has dismissed a lawsuit filed by Just Born against BCTGM Local 6 (Philadelphia) workers who went on strike in 2016.

In a 15-page opinion, U.S. District Judge Jeffrey L. Schmehl ruled on December 29 that the company failed to prove that the Local 6 members violated a no-strike clause in the collective bargaining agreement.

About 400 Local 6 members went on strike on September 7, 2016. Workers returned to work in late October 2016, although a new contract has still not been reached and negotiations have yet to be scheduled.

While Just Born’s lawsuit said the workers’ decision to go on strike violated a no-strike provision of the union contract, which had expired the previous June, Schmehl wrote that there was no evidence to conclude that the workers gave up their right to strike. 

Despite the ruling, Just Born has filed an appeal to the decision.

“It was a frivolous lawsuit from the beginning,” said Hank McKay, BCTGM Local 6 president. McKay noted that instead of spending money on lawsuits and other legal actions against the workers, Just Born, “could put the money toward settling the expired union contract.”

BCTGM Members Join Worker Day of Action Events

BCTGM Local 6 members were among thousands of workers who rallied in Philadelphia’s Thomas Paine Plaza on February 24 ahead of a Supreme Court vote that could profoundly affect the ability of public-sector workers to improve their wages and working conditions. The Philadelphia rally, which included AFL-CIO President Richard Trumka, was a part of the national “Workers Day of Action” movement, which included events in 28 cities.

Today, February 26th, the Supreme Court is scheduled to hear oral arguments in Janus v. AFSCME, a case that threatens the right of the majority of workers to bargain with their public employer, through their democratically elected union.

While the outcome of the case will affect about 17 million public-sector workers across the country, black women in particular could be hurt by Janus, as they are disproportionately represented in public sector jobs. They make up 17.7 percent of public-sector workers, or about 1.5 million workers.

If the Supreme Court decides in favor of weakening unions, it will impact the future of democratic decision making in the workplace and the preservation of good, middle-class jobs in public employment that have traditionally benefited African American women who have chosen to serve the public for their careers. – Economic Policy Institute

BCTGM Local 83 Members Tell Disney: Treat Us All Fairly and Equally

As a result of the federal tax cut, Disney promised that its employees would get $1,000 bonuses. Disney offered the bonuses to most of its employees with no conditions. But for 41,000 union members in Anaheim, California and Orlando, Florida, Disney is requiring them to agree to the company’s contract proposals in order to get the bonus.

More than 100 BCTGM Local 83 (Buena Park, Calif.) members are candy production workers at the Disneyland park in Anaheim, Calif.

The local union is part of a large coalition of labor unions in both Orlando and Anaheim that are currently in contract negotiations with Disney.

A new report reveals that 73% of Disneyland Resort workers say they do not earn enough for basic expenses every month, and 11% report having been homeless. The coalition has published petition to help keep the momentum going in favor of the workers who are demanding the company offer the same $1,000 bonus with no strings attached as 80,000 workers were offered.

Nestle Purina PetCare Quality Assurance Workers Say UNION YES!

When the quality assurance workers at the Nestle Purina PetCare plant in Edmond, Oklahoma realized the benefits production workers enjoyed thanks to a BCTGM collective bargaining agreement, they set out to become members of Local 366G (Oklahoma City).

Local 366G represents the 235 workers in production, processing, sanitation, maintenance, and the warehouse. And on April 19, the workers of the Nestle Purina Pet Care quality assurance department joined the ranks of the unionized plant by voting to become members of the BCTGM.

Local 366G President James Perez, Vice President Darrian Haggins, and Secretary-Treasurer Gerald Miller, together with rank-and-file members worked relentlessly to organize the quality service workers.

According to BCTGM International Representative David Woods the workers maintained solidarity despite being forced to endure a barrage of anti-union tactics by the company including captive audience meetings and management intimidation.

“I am very proud of the quality assurance workers who had the courage to resist the companies’ anti-union propaganda and anti-union strategy throughout the 23-day period between filing for an union election and being able to and vote to become members of BCTGM Local 366G,” recalls Woods.

The Nestle Purina Pet Care quality assurance workers and their supporters were overcome with joy and excitement once the final votes were counted and their union victory was official.
